2. Terms of Service

By using this website or purchasing products from CyberServers, you agree to these Terms of Service in full. If you do not agree, you must refrain from using our services or purchasing our products.

3. General Use

• All registration and payment information provided must be true, accurate, and current.
• You must not use the site for unlawful purposes.
• You must not access the site using bots, scripts, or other automated means.
• CyberServers may suspend or terminate accounts for misuse, fraud, chargebacks, abuse, or violation of our community rules.

4. Products and Usage

• Access to digital products is granted via a license key and/or user account.
• Accounts may be used on one computer or user environment only, unless otherwise stated.
• Product features may change at any time without prior notice.
• CyberServers is not liable for third-party intellectual property claims caused by user activity.

5. Prices

• All prices are displayed clearly in USD or EUR, and are not misleading.

6. Purchases and Payments

• You must provide accurate and complete billing information.
• Orders may be refused, limited, or cancelled at the discretion of CyberServers.
• Fraud, unauthorized payments, or chargebacks may result in immediate account termination.

6.1 Credit Card Information

• The location of the point of sale corresponds to the company’s establishment in The Netherlands.
• Delivery and refund policies are clearly visible on the website and at checkout, including conditions for cancellations and returns.
• Customer data and privacy are protected under the General Data Protection Regulation (GDPR). Payment data is processed securely by our payment providers and is not stored by CyberServers.

7. Right of Withdrawal & Return Policy

CyberServers fully complies with the European Union Consumer Rights Directive (2011/83/EU) and applicable Dutch consumer protection laws regarding returns, withdrawals, and refunds.

7.1 Right of Withdrawal (Online & Distance Sales)

Under EU law, you have the right to cancel and return goods purchased online, by phone, or by mail order within 14 days — without giving a reason.

• The 14-day period starts on the day you receive the goods.
• The seller must refund all payments, including standard delivery costs, within 14 days of being informed of your withdrawal.
• Refunds may be delayed until the goods are returned or proof of return is provided.
• Return shipping costs are paid by the customer unless the seller agrees otherwise or failed to inform you beforehand.

7.2 Exceptions (No Refund or Withdrawal Right)

• Custom-made or personalized goods.
• Perishable goods (e.g. food, flowers).
• Sealed items (e.g. cosmetics, software) once opened.
• Digital downloads once delivery has started, if you consented to lose the right to cancel.

7.3 Digital Products

• By purchasing digital goods from CyberServers, you expressly agree to immediate delivery and acknowledge that you waive your statutory right of withdrawal once access to the product is granted.
• Refunds for digital goods may be granted on a discretionary basis when legally required or in exceptional circumstances, subject to a 7.2% processing fee for PayPal, card, or crypto transactions.

7.4 Physical Products

• You have a 14-day right of withdrawal from the date you receive the product, in line with EU law.
• Products must be returned unused, undamaged, with all accessories, and in the original packaging.
• You must contact us first at contact@cyberservers.org before returning any item.
• The buyer is responsible for return shipping costs and any customs or import duties.
• Refunds are processed within 10 working days after inspection of the returned product and may incur a 7.2% refund processing fee for PayPal, credit/debit card, and crypto payments.

7.5 Faulty or Non-Conforming Goods

Under the EU Sale of Goods Directive (2019/771), consumers have a 2-year legal guarantee for faulty or non-conforming goods.

• The seller must repair or replace the product free of charge.
• If repair or replacement is impossible or disproportionate, you may request a refund.
• Defects appearing within the first 12 months are presumed to have existed at delivery unless proven otherwise.

8. Delivery Time

• Delivery times are indicated on the product page and/or at checkout.
• Digital products are delivered instantly after successful payment.
• Physical products are usually delivered within 3–14 business days, depending on destination and shipping method.
• In cases of force majeure (e.g. natural disasters, strikes, outages), delivery may be delayed. Customers will be informed as soon as reasonably possible.

9. Refunds & Cancellations

• Refunds and cancellations are handled in accordance with EU and Dutch consumer law for fairness and transparency.
• Refunds are not available for delivered or accessed digital goods unless required by law.
• For undelivered goods or services, cancellation is possible until the moment of shipping or activation.
• Refunds are issued using the same payment method as the original purchase unless otherwise agreed.
• Downtime compensation for online services is not guaranteed and is evaluated case-by-case.

10. Warranty Policy

• All physical products include a minimum 14-day warranty for manufacturing defects.
• Digital licenses are warranted to function as described at the time of sale when used in supported environments.
• CyberServers is not liable for issues arising from unsupported configurations, user modifications, or misuse.
• Warranty claims must be submitted by email with proof of purchase and a description of the issue.
